Affiliate Terms & Conditions

This Affiliate Programme Agreement (“Agreement”) is between an Affiliate  and Viktoria Thorbjorn. Viktoria Thorbjorn and Affiliate are collectively known as the “Parties”. Your participation in the Affiliate Programme is conditional on your acceptance of the terms and conditions contained in this Agreement. You are deemed to have accepted this Agreement by applying to participate in the Affiliate Programme.

Modification

Viktoria Thorbjorn may modify any of the terms and conditions within this Agreement at any time and at her sole discretion.

These modifications may include, but are not limited to changes in the scope of available referral fees, fee schedules, payment procedures and Affiliate Programme rules.

If any of the modifications are UNACCEPTABLE TO YOU, your only recourse is to terminate this Agreement.

If you CONTINUE PARTICIPATION IN THE PROGRAMME, it will be considered as your acceptance of the change. All changes made will be announced to affiliates via the email address they have supplied.

Enrollment

You must submit an affiliate application and be approved to enrol in the affiliate programme. Applications are processed weekly, and applicants will be notified of their acceptance status as soon as possible after their information has been reviewed.

Affiliate URLs

Once you become an approved member of the Affiliate Programme, you will be issued your own affiliate dashboard, which will be unique to you and you only. This dashboard will provide you with ready-made links containing your affiliate ID number.

For Painting Workshops

Commissions

Affiliates will receive 20 – 30% (if not stated differently on the individual offer) of the revenue as a commission from orders placed through properly coded Affiliate links (unless noted otherwise for a particular product). Commissions are only available for paid courses and products. There will be no commissions paid for clicks or leads.

The percentage of the commission of every offer will be available for approved Affiliates.

Viktoria Thorbjorn may increase commissions during limited-time special promotions, but they will return to the regular commission rate thereafter.

For sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered through the secure order system.

If customers purchase through a payment plan, the affiliate commission will only be released partly as payments come in.

Word-of-mouth referrals will not generate an affiliate commission.

Commissions will only be paid on sales made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate.

Viktoria Thorbjorn uses Stripe and PayPal to accept payments, and as such, all payments are subject to Stripe’s and PayPal’s transaction fees. This means that the actually received payments of 20 – 30% will be paid to affiliates as a commission.

The exact commission will be transferred to the Affiliate; Viktoria Thorbjorn will not pay additional fees on top of the 20 – 30% commission to cover PayPal’s transaction fees.

For Physical products, prints and commissioned art

Commissions

Affiliates will receive 5 – 20% (if not stated differently on the individual offer) of the revenue as a commission from orders placed through properly coded Affiliate links (unless noted otherwise for a particular product). Commissions are only available for paid products. There will be no commissions paid for clicks or leads.

The percentage of the commission of every offer will be available for approved Affiliates.

Viktoria Thorbjorn may increase commissions during limited-time special promotions, but they will return thereafter to the regular commission rate.

For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered through the secure order system. For commissioned art from the £200 deposit, the Affiliate will not receive a commission, but once the ready product has been delivered and paid, the appropriate commission will be paid for the full amount to the Affiliate.

If customer purchase through a payment plan, the affiliate commission only will be released partly, as payments come in, but nothing for the non-refundable £200 deposit for securing space on the waiting list for commissioned art.

Word of mouth referrals will not result in an affiliate commission being generated.

Communication

You agree to receive email or other electronic communications from Viktoria Thorbjorn including but not limited to newsletters, site updates, promotion resources, and other announcements and correspondence. You agree that all electronically-sent agreements, notices, disclosures and other communications that we provide satisfy any legal requirement that such communications be in writing. I accept no responsibility for the accurate receipt of any such emails and you are responsible for ensuring that your email address is not blocked or impaired in any way, including by ensuring ‘white-listing’ of Viktoria Thorbjorn’s email addresses.

If you unsubscribe from receiving Viktoria Thorbjorn’s emails, you acknowledge and understand that you may no longer receive information or updates from Viktoria Thorbjorn, related courses, or any of our other properties.

Payment

Viktoria Thorbjorn pays affiliates via a PayPal account, provided to her when a member joins. If the PayPal email changes, it is the responsibility of the affiliate to update their information in the Affiliate dashboard to ensure proper commission payments. I can not resend payments returned due to incorrect payment email addresses.

Affiliate recognises and understands that if one of its sales is refunded or results in a successful chargeback, Affiliate will forfeit its commission to Viktoria Thorbjorn.

Affiliate is responsible for monitoring any and all commission account(s) for any discrepancies it feels has occurred and reporting any such discrepancy in a timely manner to Viktoria Thorbjorn.

Order Fulfillment

Viktoria Thorbjorn will be solely responsible for processing every order placed by a customer via affiliate links.

Affiliates are not authorised to collect payments or sell any of Viktoria Thorbjorn’s offers/services/products from other websites as a “reseller”, and no “resale” rights are granted in ANY way. Affiliates are not authorised to sell these products on eBay or other auction sites. Affiliates are not authorised to give away copies of any of these products.

Viktoria Thorbjorn will also be solely responsible for all customer service inquiries.

All affiliates understand and acknowledge that no physical products will be shipped.

Customers who purchase products and services through Viktoria Thorbjorn’s Affiliate Programme will be deemed to be customers of Viktoria Thorbjorn. Accordingly, all rules, policies, and operating procedures concerning customer orders and services will apply to those customers.

Viktoria Thorbjorn may change her policies and operating procedures at any time. Prices and availability of her products and services may vary occasionally. Viktoria Thorbjorn’s policies will always determine the price paid by the customer.

Quaifying Sites

Viktoria Thorbjorn reserves the right to refuse site entry into the Affiliate Programme based on site content.

Sites that do not qualify for the Affiliate Programme include sites which:

  • Promote sexually explicit materials
  • Promote violence
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
  • Promote illegal activities
  • List coupon codes or discounts that were NOT officially provided to them by this programme
  • Infringe or otherwise violate any copyright, trademark, or other intellectual property rights of Viktoria Thorbjorn

Do you want to promote a coupon? Contact me and I can work with you. You may NOT promote coupon codes you may have found elsewhere online. Doing so can result in the termination of your affiliate account and withholding of affiliate payments for violating our affiliate agreement.

Permitted Usage

The following are permitted uses of the Viktoria Thorbjorn’s brands and marketing resources:

Affiliates are permitted to use the graphical banners and design resources supplied to them via the Affiliate Area. If a specific size banner ad is not available, the affiliate may contact Viktoria Thorbjorn at hello [at] vikithorbjorn [dot] art  and request a new banner graphic be added to the available resources.

Affiliates are not allowed to create their own banners without getting proper (written) permission first.

Prohibited Usage

The following cases are prohibited and are grounds for immediate termination of the affiliate account:

  • Affiliates MAY NOT use Viktoria Thorbjorn’s logo, logo marks or other brand imagery in a header graphic or in any as to indicate they are officially associated with Viktoria Thorbjorn
  • Affiliates MAY NOT use the terms “Viktoria Thorbjorn”, “Viki Thorbjorn”, “Viki Thorbjorn Art” in ANY variation in their site URL ex. (viktoriathorbjornart.net, vikithorbjorn.co.uk, vikithorbjorn-art.com, viktoriathorbjorn-art.com viktoriathorbjorncouponcodes.com, viktithorbjorncouponcodes.com, viktoriathorbjorn-painting.com, viktoriathorbjorn.painting.co.uk, etc).
  • Affiliates MAY NOT promote coupons that were not provided to them personally by Viktoria Thorbjorn.
  • Affiliates MAY NOT host or promote “coupon stacking” sites where customers may combine coupons to receive additional discounts.
  • Affiliates MAY NOT make purchases utilising their own, unique affiliate links. To clarify, you, as an affiliate, cannot register yourself as a referral.

Anti-Spam Policy

  1. Viktoria Thorbjorn strictly prohibits affiliates from using spam e-mail and other forms of Internet abuse (including spamming forums, blogs, Twitter, Facebook and other social media outlets) to seek sales. Spam is defined as including, but not limited to, the following:

    • Electronic mail messages addressed to a recipient with whom the sender does not have an existing business or personal relationship or is not sent at the request of, or with the express consent of, the recipient through an opt in subscription.
    • Messages posted to Usenet, forums, Twitter, Facebook and message boards that are off-topic (unrelated to the topic of discussion), cross-posted to unrelated newsgroups, posted in excessive volume, or posted against forum/message board rules. Be conscious of forum rules! If a forum owner or moderator complains that an affiliate has spammed, the affiliate account may be permanently terminated after investigation.
    • Content posted on free blog websites for the sole purpose of keyword spamming, or comments posted to legitimate blogs that violate the comment policy of the blog owner.
    • Solicitations posted to chat rooms, or to groups or individuals via Internet Relay Chat or “Instant Messaging” system.
    • Certain off-line activities that, while not considered Spam, are similar in nature, including distributing flyers or leaflets on private property or where prohibited by applicable rules, regulations, or laws.

    Viktoria Thorbjorn may undertake, at her sole discretion and with or without prior notice, the following enforcement actions:

    Account Termination: Upon the receipt of a credible complaint, the Viktoria Thorbjorn may investigate the complaint, and if necessary, will then terminate the affiliate account of the individual implicated in the abuse. Termination results in the immediate closure of the member and affiliate account, the loss of all referrals, and the forfeiture of any unpaid money on account. At Viktoria Thorbjorn’s discretion, termination may not only result in being banned from the affiliate programme, but also being banned from ANY other internal affiliate programmes.

Relationship of Parties

Affiliates are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. Affiliates have no authority to make or accept any offers or representations on our behalf. Affiliates will not make any statement, whether on their sites or otherwise, that reasonably would contradict this statement.

Confidentiality

Affiliate and Viktoria Thorbjorn may, at times, disclose certain information as a result of their participation in the Affiliate Programme. The Parties shall collectively and individually keep all trade secrets, discussions and other privileged information within the course of maintaining and promoting anything of or related to the purpose of the Affiliate Programme, their individual businesses, or this Agreement confidential. Information is privileged when it would otherwise materially harm either of the Affiliate or Viktoria Thorbjorn in their individual businesses, or describe information that is not public nor ever intended to be public.

Public or Prior Knowledge. Confidential information does not include any previously known information prior to entering this Agreement, any information publicly disclosed (other than by disclosing Party or related parties), or any information that is required to be disclosed by law, order of a court or other judicial or administrative body.

Breach of Confidentiality. If a breach of confidentiality occurs accidentally or willfully, the non-breaching party is entitled to any actual damages and/or an injunction as a result of the breach.

Term and Termination

The term of this Agreement will begin when you apply to join the programme and will end when terminated by either party. Either Viktoria Thorbjorn or the affiliate may terminate this Agreement at any time, with or without cause. Upon the termination of this Agreement for any reason, all licenses granted here under shall immediately terminate and you will immediately cease use of, and remove from Affiliate’s Web Site, all links to the Viktoria Thorbjorn’s websites, trademarks and logos, other marks, and all other materials provided in connection with this programme.

Limitation of Liability

Viktoria Thorbjorn will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures or data) arising in connection with this Agreement or the Programme, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Programme will not exceed the total commissions paid or payable to the affiliate under to this Agreement.

Disclaimers

Affiliate Programme. In addition, Viktoria Thorbjorn makes no representation that the operation of the websites or the Affiliate links will be uninterrupted or error-free, and Viktoria Thorbjorn will not be liable for the consequences of any interruptions or errors.

Miscellaneous

Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.

By signing up with the Viktoria Thorbjorn Affiliate Programme, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this programme and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
